User agrees that neither equalsideCompany nor its group companies, directors, officers or employee shall be liable for any direct or/and indirect or/and incidental or/and special or/and consequential or/and exemplary damages, resulting from the use or/and the inability to use the service or/and for cost of procurement of substitute goods or/and services or resulting from any goods or/and data or/and information or/and services purchased or/and obtained or/and messages received or/and transactions entered into through or/and from the service or/and resulting from unauthorized access to or/and alteration of user's transmissions or/and data or/and arising from any other matter relating to the service, including but not limited to, damages for loss of profits or/and use or/and data or other intangible, even if equalsideCompany has been advised of the possibility of such damages.

User further agrees that equalsideCompany shall not be liable for any damages arising from interruption, suspension or termination of service, including but not limited to direct or/and indirect or/and incidental or/and special consequential or/and exemplary damages, whether such interruption or/and suspension or/and termination was justified or not, negligent or intentional, inadvertent or advertent.

User agrees that equalsideCompany shall not be responsible or liable to user, or anyone, for the statements or conduct of any third party of the service. In sum, in no event shall Company's total liability to the User for all damages or/and losses or/and causes of action exceed the amount paid by the User to Company, if any, that is related to the cause of action.

DISCLAIMER OF CONSEQUENTIAL DAMAGES

In no event shall Company or any parties, organizations or entities associated with the corporate brand name us or otherwise, mentioned at this Website be liable for any damages whatsoever (including, without limitations, incidental and consequential damages, lost profits, or damage to computer hardware or loss of data information or business interruption) resulting from the use or inability to use the Website and the Website material, whether based on warranty, contract, tort, or any other legal theory, and whether or not, such organization or entities were advised of the possibility of such damages.

SERVICE & PAYMENT TERMS

100% amount as Advance.

All the payments should made on or before the date of promised delivery; in favor of “BS Teknology Private Limited, Madurai, Tamilnadu, India”.

Cheque Payments are subject to realization. If dishonored then the Client hereby agree to pay penalty

Rs. 1,000/- (one thousand only) per dishonor.

Training for software / web site will be provided to the agreed number of persons in the agreement. If you need additional training Rs. 800/- per day per head is chargeable.

The Client here by agrees to pay to & fro, food & beverages charges for our executive(s) who enter to Client premises for Installation/Training/Service.

In case of incomplete payment the software / web site is subject to stop from the 5^th day of installation / upload and 2% interest per month is applicable on balance.

The agreed promised delivery date may subject to change due to the Natural ad-hocs / Local or International issues which are causing problems to design / development / server maintenance environment.

The project cost mentioned in agreement does not include source code, copy right images, sdlc documents, and might subject to vary depend upon the modifications made by the Client during or after project developing cycle.

Company does not have any liability for data corruption’s occurred in the SaaS / software / website delivered

We can do audit-trail on request; for data corruption. However the appropriate charges are applicable.

Client cannot cancel the order. If canceled the advance amount cannot be refund at any reason. On cancellation the Client here by agrees to pay the men and machine cost which ever applicable.

However, company reserved the rights to cancel the order at any point of time without prior notice.

You here by agree to receive SMS from BS Teknology Private Limited; based on the willingness you have provided in this order form.

If the client does; any violation of Indian or International Laws, then the company hold the rights to stop their software / web site; and hand over the data’s to the respective authorized government departments.

Any notice sent will be deemed to have been given when it shall be delivered by hand, mail, telegram, or registered post or courier to the client at the address mentioned herein. The client shall immediately intimate “BS Teknology Private Limited” of any change in address.

“BS Teknology Private Limited reserves the rights to alter, amend or reverse any of these terms and conditions and may notify the client of any changes in terms and conditions in any manner it considers appropriate”

*** The Client here by agree that any legal action or proceedings arising out of this agreement shall be brought in the courts of tribunals at Madurai, India.
